What is RERA and how does it protect homebuyers?

The Real Estate (Regulation and Development) Act, 2016 (RERA) is a landmark law that regulates the real estate sector, mandates developer registration, and provides homebuyers with a fast-track complaint mechanism for possession delays, false representations, and structural defects. Penalties can include interest on delayed possession, refunds, and even imprisonment of developers for non-compliance.

Can I get a refund if my builder delays possession?

Yes. Under RERA, if a builder fails to deliver possession by the agreed date, the buyer is entitled to withdraw from the project and receive a full refund with interest — or continue with the project and receive interest for every month of delay. The applicable interest rate is typically the SBI MCLR + 2%. We file RERA complaints and recover refunds and compensation for aggrieved buyers.

What is title verification and why is it important?

Title verification is the legal examination of a property's ownership history to confirm that the seller has clear, marketable, and encumbrance-free title. What is a Joint Development Agreement (JDA)?

A JDA is an agreement between a landowner and a developer for the development of property — typically in exchange for a share of the developed units or revenue. JDAs carry significant legal and financial risk if not properly structured. We draft and negotiate JDAs that clearly define the revenue share, development obligations, timelines, penalties, and exit rights of both parties.

How long does a RERA complaint take to resolve?

RERA complaints are designed to be resolved within 60 days of filing, though in practice timelines vary by state and complexity. Appeals to the Real Estate Appellate Tribunal (REAT) must be filed within 60 days of a RERA order.
